2. SCOPE
These Terms and Conditions govern purchases made through degliubertistore.com by consumers. By placing an order, the customer confirms that the information provided is accurate and that they have read these Terms, the Privacy Policy, the Shipping Policy and the Refund Policy.
Mandatory consumer rights under applicable Italian and European Union law remain unaffected.
3. PRODUCTS AND AVAILABILITY
Product descriptions, images, sizes, colours and other information are provided as accurately as reasonably possible.
Small differences in colour may occur due to screens, lighting or photography.
All orders are subject to product availability. If an item becomes unavailable after an order has been placed, the customer will be informed and any amount paid for that unavailable item will be refunded using the original payment method.
4. ARCHIVE / VINTAGE / PRE-OWNED ITEMS
Products offered in the Archive section may be vintage, pre-owned, collectible, discontinued or otherwise previously owned items.
Archive items are generally unique or available in very limited quantities. Their age and previous use may result in signs of wear, ageing, minor imperfections, colour variation, repairs or other characteristics consistent with the nature and history of the item.
For each Archive item, customers should carefully review the product description, condition information and photographs before purchasing. Any known material signs of wear or defects will be described or shown as clearly as reasonably possible.
Characteristics that are clearly disclosed as part of the item's condition do not affect the customer's statutory rights in relation to defects or lack of conformity that were not accurately disclosed.
Unless a shorter lawful period is expressly agreed with the consumer at the time of purchase, the statutory legal guarantee of conformity applies for two years from delivery. Italian law permits, for second-hand goods, an expressly agreed shorter period which may not be less than one year.
Archive items remain subject to the statutory right of withdrawal for distance sales, subject to the exclusions provided by law.
5. PRICES AND TAXES
Prices displayed on the website are shown in the currency applicable to the relevant market and include taxes where required by applicable law.
Shipping charges, customs duties, import taxes or other charges, where applicable, are shown or communicated according to the destination and the applicable Shipping Policy.
Customers ordering from outside the European Union may be responsible for import duties, taxes or customs charges imposed by the destination country.
6. ORDERS AND CONTRACT FORMATION
The customer may review and correct the order before completing checkout.
Submitting an order constitutes an offer to purchase. The sales contract is concluded when the order is accepted by Degli Uberti, including through the order confirmation process provided by Shopify.
Degli Uberti may refuse or cancel an order where permitted by law, including in cases of pricing errors, suspected fraud, payment failure, product unavailability or other legitimate reasons. Where payment has already been collected for a cancelled order, the relevant amount will be refunded.
7. PAYMENT
Available payment methods are displayed at checkout.
Payments may be processed by Shopify and/or third-party payment providers. Customers are responsible for providing complete and accurate billing and payment information.
8. SHIPPING AND DELIVERY
Orders are shipped to the delivery address provided by the customer.
Shipping methods, costs, estimated delivery times and destination-specific information are set out in the Shipping Policy and at checkout.
Unless otherwise agreed, goods will be delivered without undue delay and in any event within the time limits required by applicable consumer law.
9. RIGHT OF WITHDRAWAL
Consumers purchasing online generally have the right to withdraw from the purchase within 14 days from the day on which they, or a third party designated by them, receive the goods, without having to provide a reason, except where a statutory exception applies.
To exercise the right of withdrawal, the customer must communicate the decision to Degli Uberti within the applicable period by an unequivocal statement sent to:

10. RETURNS AND REFUNDS
Returned products must be handled in accordance with the Refund Policy.
The consumer may inspect a product only to the extent necessary to establish its nature, characteristics and functioning. The customer may be responsible for any diminished value resulting from handling beyond what is necessary for this purpose, as provided by applicable law.
Refunds due following a valid withdrawal will be processed in accordance with applicable consumer law and the Refund Policy.
11. LEGAL GUARANTEE OF CONFORMITY
Consumers benefit from the legal guarantee of conformity provided by applicable Italian and EU consumer law.
Where a product is not in conformity with the sales contract, the consumer may be entitled, depending on the circumstances and the remedies provided by law, to repair or replacement, a proportionate price reduction, or termination of the contract and refund.
For used goods, the nature, age, previous use and condition of the product are taken into account when assessing conformity.
12. PROMOTIONS AND DISCOUNTS
Promotional codes, discounts and special offers are subject to the conditions stated with the relevant promotion.
Unless otherwise expressly stated, discounts cannot be combined. The application of promotional discounts does not reduce statutory consumer rights.
13. INTELLECTUAL PROPERTY
The content of this website, including text, graphics, logos, photographs, videos, design elements and other materials, is protected by applicable intellectual property laws unless otherwise stated.
Nothing in these Terms transfers any intellectual property right to the customer.
Third-party trademarks and brand names remain the property of their respective owners.

Personal data is processed in accordance with the Privacy Policy available on the website.

Any mandatory rules concerning consumer jurisdiction remain unaffected.
17. CHANGES TO THESE TERMS
These Terms may be updated from time to time to reflect legal, regulatory, technical or commercial changes.
The version applicable to an order is the version in force when the order is placed.
